Terms of Service
Effective Date: September 21, 2026
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Cole WebCraft Services Inc., a British Columbia company that operates RentalCal ("RentalCal," "we," "us," or "our"). By creating an account, accessing, or using any part of the RentalCal service, including the owner dashboard at app.rentalcal.com, the embeddable booking widget, and all related APIs and integrations (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
RentalCal is a calendar synchronization and direct booking management platform for vacation rental property owners and managers. The Service includes:
- Importing and synchronizing availability calendars (iCal feeds) from third-party platforms such as Airbnb, VRBO, and Booking.com.
- An owner dashboard for managing properties, availability, pricing, and booking requests.
- An embeddable booking widget that property owners can place on their own websites to receive direct booking requests from guests.
- Exporting a unified iCal feed for distribution back to third-party platforms.
- The site builder, for building a property website, and pages we host for you at www.rentalcal.com: link-in-bio pages (RentalCal Link) and offer pages that collect a guest email list.
- Guest chat, a widget that lets guests message you from your website.
- A public booking API that lets AI assistants and partner websites check availability and request bookings on a guest's behalf, and an owner API for your own integrations.
- Team access, so you can invite other people into your account.
- Transactional and marketing email communications related to the Service.
2. Eligibility and Account Registration
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By registering, you represent that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
If you invite other people into your account, you decide what role each one has, you are responsible for what they do in your account as if you had done it yourself, and you should remove their access as soon as they no longer need it. An invited person uses the Service under these Terms too.
3. User Responsibilities
You agree to:
- Use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including any local short-term rental regulations.
- Ensure that all property listings, pricing, availability, and other information you provide is accurate and up to date.
- Obtain any necessary consents before collecting guest information through the booking widget embedded on your website.
- Not attempt to reverse-engineer, decompile, or otherwise interfere with the operation of the Service.
- Not use the Service to send spam, harass others, or engage in fraudulent activity.
4. Booking Requests and Financial Transactions
RentalCal facilitates the submission and management of booking requests between guests and property owners. Pricing displayed in the widget and dashboard is an estimate provided for convenience.
RentalCal does not process payments, handle funds, or act as an escrow or payment intermediary. All financial transactions between owners and guests occur outside the Service and are solely between those parties. We are not responsible for disputes, chargebacks, non-payment, or any financial arrangements between owners and guests.
4.1 Stripe Connect (Payment Platform)
RentalCal offers an optional integration with Stripe Connect that allows property owners to accept guest payments directly through their own Stripe accounts. By enabling this feature, you acknowledge and agree that:
- You are the merchant of record for all guest payment transactions processed through your connected Stripe account.
- You are solely responsible for all refunds, chargebacks, disputes, cancellations, and guest complaints related to payments.
- You are bound by Stripe's Connected Account Agreement and all applicable Stripe policies.
- RentalCal acts solely as a technology platform connecting your Stripe account to the booking widget and does not control, process, or hold any guest funds.
- RentalCal may collect platform fees from transactions processed through connected accounts, as disclosed at the time of connection.
- You are responsible for complying with all applicable tax, consumer protection, and financial regulations in your jurisdiction.
You agree to indemnify and hold harmless RentalCal from any claims, losses, or damages arising from payment disputes, chargebacks, or regulatory actions related to guest payments processed through your connected Stripe account.
5. Calendar Synchronization
The Service imports and exports iCal feeds to synchronize availability across platforms. While we make commercially reasonable efforts to keep calendars synchronized accurately and promptly, we do not guarantee real-time accuracy, uninterrupted sync, or the absence of calendar conflicts. You acknowledge that:
- Sync delays, third-party platform outages, or feed format changes may result in temporary inaccuracies.
- Double bookings may still occur due to factors outside our control.
- You are ultimately responsible for monitoring your availability and resolving conflicts.
6. Subscription Tiers, Add-Ons, and Fees
RentalCal offers free and paid subscription tiers. Features and limitations vary by tier. We reserve the right to modify pricing, features, or tier structures at any time with reasonable notice (at least 30 days for price increases). Continued use of the Service after pricing changes constitutes acceptance of the new terms.
- Billing: Subscriptions are billed in advance on a monthly or annual basis. All fees are in the currency displayed at checkout and are non-refundable except as described in our Refund Policy.
- Add-ons: Additional property slots and other add-ons may be purchased separately. Add-ons are billed at the same interval as your base subscription and are subject to the same cancellation terms.
- Failed payments: If a payment fails, we may retry the charge and/or restrict access to paid features until the payment issue is resolved.
- Taxes: You are responsible for any applicable taxes on your subscription. Fees shown may not include taxes, which will be added where required by law.
7. Embeddable Widget and Guest Personal Information
If you embed the RentalCal booking widget on your website, you are responsible for:
- Ensuring your website's privacy policy adequately discloses the collection of guest data through the widget.
- Complying with all applicable data protection laws regarding guest information collected via the widget.
- Displaying the widget in a manner that does not mislead guests about the nature of the booking process.
We grant you a limited, non-exclusive, revocable license to embed the widget on websites you own or control, solely for the purpose of receiving booking requests for your properties.
7.1 Data Processing Terms
When RentalCal processes personal information about your guests and other people on your behalf (booking requests, chat messages, email list signups, and similar information, "Guest Data"), you are the controller and RentalCal is your processor or service provider. This Section 7.1 is our data processing agreement with you for the purposes of Article 28 of the GDPR, the UK GDPR, and similar laws.
- Scope. We process Guest Data to provide the Service to you, for as long as your account exists. It concerns your guests, prospective guests, and list subscribers, and includes contact details, booking details, messages, and payment status.
- Instructions. We process Guest Data only on your documented instructions, which are these Terms and the settings you choose in the Service, unless the law requires otherwise. In that case we will tell you first, unless the law forbids it.
- Confidentiality.Everyone at RentalCal with access to Guest Data is bound to keep it confidential.
- Security. We protect Guest Data with the measures described in Section 5 of our Privacy Policy.
- Subprocessors. You authorize the providers listed in Section 3.2 of our Privacy Policy. We will tell you at least 30 days before adding or replacing a provider that handles Guest Data. If you object on reasonable data protection grounds and we cannot resolve it, you may close your account and we will refund the unused part of any prepaid fees. We hold each provider to data protection terms at least as protective as these, and remain responsible for them.
- Assistance. We will help you answer requests from people exercising their privacy rights, and help you meet your obligations on security, breach notification, and impact assessments, as far as the nature of the processing and the information available to us allow.
- Breaches. We will notify you without undue delay after becoming aware of a breach affecting Guest Data.
- Deletion. You can export Guest Data at any time. When you delete your account, we delete it, unless the law requires us to keep it.
- Audits. We will make available the information you reasonably need to show that these obligations are met, and allow reasonable audits on 30 days' notice, no more than once a year unless a regulator requires it or after a breach.
- Transfers. Transfers of Guest Data rely on the safeguards described in Section 10 of our Privacy Policy.
RentalCal is a controller, not your processor, for the limited information it uses for its own purposes: security and abuse prevention, visit counts on hosted pages, and billing.
8. Site Builder and Hosted Pages
RentalCal allows you to create property websites hosted on our subdomains (*.rentalcal.com). By using the site builder, you agree that:
- You are solely responsible for all content published on your booking site, including text, images, and contact information.
- RentalCal reserves the right to remove or disable any booking site that violates our Acceptable Use Policy, these Terms, or applicable law.
- Subdomains are provided on a non-exclusive basis. We may reclaim subdomains that are inactive, misleading, or infringe on third-party rights.
- Site builder availability is subject to your subscription tier. Sites may become inaccessible if you downgrade below the required tier.
Link-in-Bio Pages and Offer Pages
You can also publish link-in-bio pages (RentalCal Link) and offer pages, which we host at www.rentalcal.com. By publishing one, you agree that:
- You are solely responsible for everything on the page: its text, its photos, its links, and the websites those links lead to. Links must not lead to unlawful, deceptive, or malicious content.
- You will only upload photos and images that you own or have permission to use, and you will not use another company's name or logo in a way that suggests it endorses or is affiliated with you.
- Page addresses (rentalcal.com/your-name) are provided on a non-exclusive basis. We may reclaim an address that is inactive, misleading, or infringes on third-party rights.
- Link-in-bio pages are free on every plan and carry a "Powered by RentalCal" line linking to our website. You may not remove, hide, or obscure it.
- When guests join your email list through an offer page or the booking widget, you are the sender of any email you send them and you are responsible for complying with the laws that apply, including Canada's Anti-Spam Legislation (CASL), the U.S. CAN-SPAM Act, and the GDPR. You will only email people about what they agreed to receive, identify yourself in every message, and honour every unsubscribe request promptly, including keeping any list you export in step with unsubscribes recorded in RentalCal.
- Visit and tap counts are estimates. Visitors who send a Global Privacy Control or Do Not Track signal are not counted.
- Anyone can report a hosted page to us. RentalCal may remove or disable any page that violates our Acceptable Use Policy, these Terms, or applicable law, and may do so without notice where we believe the content is unlawful or harmful.
9. AI-Generated Content
RentalCal uses third-party AI services (including Anthropic and OpenAI) to generate suggested content for booking sites, such as property descriptions, taglines, amenity lists, and images. By using these features, you acknowledge that:
- AI-generated content is provided as a suggestion only. You are responsible for reviewing, editing, and approving all content before it is published.
- AI-generated content may contain inaccuracies, and RentalCal makes no warranty regarding its accuracy, completeness, or suitability.
- You are solely responsible for ensuring that all published content (whether AI-generated or manually written) complies with applicable laws, including truth-in-advertising and consumer protection regulations.
- AI-generated images are created for illustrative purposes and may not represent actual property features or conditions.
10. Intellectual Property
All rights, title, and interest in and to the Service, including its design, code, features, trademarks, and documentation, are and remain the exclusive property of RentalCal. You retain ownership of any content you upload or submit (property descriptions, images, logos). By uploading content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content solely as necessary to operate and provide the Service.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT CALENDAR SYNC WILL BE PERFECTLY ACCURATE, THAT BOOKING REQUESTS WILL BE DELIVERED WITHOUT DELAY, OR THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RENTALCAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOST BOOKINGS, DOUBLE BOOKINGS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER.
Nothing in these Terms limits or excludes liability for fraud, gross negligence, or wilful misconduct, your obligation to pay fees you owe, your obligations under Section 13, or any liability that cannot be limited or excluded by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless RentalCal and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any applicable policy; (c) your violation of any applicable law; (d) disputes between you and your guests, including payment disputes, chargebacks, and refund claims; (e) content you provide through the Service, including booking sites; or (f) your use of Stripe Connect and any claims related to guest payments processed through your connected Stripe account.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. If we terminate your account without cause, we will give you at least 30 days' notice where we reasonably can, and refund the unused part of any prepaid fees. No refund is due if we terminate because you breached these Terms or our Acceptable Use Policy. You may delete your account at any time through the Settings page in your dashboard, or by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. Any provisions of these Terms that by their nature should survive termination shall survive.
15. Third-Party Services
The Service integrates with third-party platforms (including but not limited to Airbnb, VRBO, Booking.com, Google Calendar, and Stripe) through iCal feeds, APIs, and payment integrations. We are not affiliated with, endorsed by, or responsible for these third-party services. Your use of those platforms is governed by their respective terms and policies. We are not liable for any changes, outages, or issues caused by third-party services.
16. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email or a notice within the Service. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
17. Force Majeure
RentalCal shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemic, internet or telecommunications failures, third-party service outages (including Stripe, calendar platforms, and cloud providers), cyberattacks, or other force majeure events.
18. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in British Columbia, Canada, and you consent to the personal jurisdiction of such courts.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, Cookie Notice, and Acceptable Use Policy, constitute the entire agreement between you and RentalCal with respect to the Service and supersede all prior agreements, understandings, and communications.
